General Terms and Conditions of FineSell GmbH

Section 1 Scope and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

(2) A "consumer" within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for a purpose that is predominantly outside their trade, business or profession.

Section 2 Conclusion of contract, storage of the contract text

(1) The following provisions on the conclusion of a contract apply to orders placed through our online shop https://campmatic.de as well as through our sales channels (e.g. Etsy).

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

(4) The following applies on receipt of an order: The consumer makes a binding offer by successfully completing the order procedure provided. We confirm receipt of the order immediately by an automatically generated email ("order receipt confirmation"). This confirmation merely documents that the order has reached us and does not yet constitute acceptance of the offer.

(5) A purchase contract is concluded only when we dispatch the ordered goods to the consumer and confirm the dispatch by a separate email ("dispatch confirmation"). Neither the order nor a payment already made brings about the conclusion of a contract on its own. If we do not accept the offer by dispatch within fourteen days of receiving the order, the offer is deemed rejected; in that case we refund any payments already made without undue delay and in full.

(6) Storage of the contract text: We store the contract text and send you the order details and our Terms and Conditions by email.

Section 3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory VAT and other price components. Any shipping costs are added.

(2) The consumer may pay in advance or by the payment methods offered by the respective sales channel.

(3) If the consumer has chosen payment in advance, they undertake to pay the purchase price without undue delay after placing the order. Payment is made before the contract is concluded; if no contract comes about under Section 2, we refund the amount without undue delay and in full.

Section 4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are dispatched within 3–5 days of receipt of the order.

(2) If the consumer has chosen payment in advance, we do not dispatch the goods before receipt of payment.

Section 5 Retention of title

We retain title to the goods until the purchase price has been paid in full.

Section 6 Right of withdrawal

Withdrawal instructions

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

To exercise the right of withdrawal, you must inform us (FineSell GmbH, Chemnitzer Str. 36, 09247 Chemnitz-Röhrsdorf, Tel.: 03722 / 40 66 933, E-Mail: info@finesell.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Section 7 Return costs in the event of withdrawal

If you exercise your right of withdrawal, you shall bear the direct cost of returning the goods.

Section 8 Contract language

German is the only language available for the contract.

Section 10 Choice of law and place of jurisdiction

The law of the Federal Republic of Germany applies, excluding all international and supranational (contract) legal systems, in particular the UN Convention on Contracts for the International Sale of Goods.

Towards merchants, the exclusive — including international — place of jurisdiction is the Regional Court of Chemnitz. However, we are also entitled to bring an action at the general place of jurisdiction of the buyer.

Online dispute resolution pursuant to Art. 14(1) ODR Regulation: The European Commission provides a platform for online dispute resolution (ODR). We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (section 36 VSBG). Participation in the EU ODR platform is therefore excluded.

Should individual provisions of this contract be invalid or contrary to statutory provisions, the remainder of the contract shall remain unaffected.
